These terms and conditions govern the services provided by us through our website, social media handles, or any other platform used by Shades of Beauty.

The term “user”, “you”, or “your” refers to any user/viewer of our platform, his/her representatives or affiliates; and any person availing our services through our website, social media handles or any other medium.

6. Exchange Policy (No Refund)

We take great pride in the quality of our products. However, if you are not completely satisfied with your purchase for a valid reason (such as a manufacturing defect or damage during transit), we offer an exchange only.

  • No Refunds: We do not offer cash refunds under any circumstances.

  • Exchange Requests: Exchange requests must be initiated within 7 days of delivery.

  • Conditions for Exchange: The product must be unused, unwashed, and in its original condition with all tags and packaging intact.

  • Process: To request an exchange, please contact our customer support team with your order details and a clear photo of the product showing the issue.

  • Shipping: Customers may be required to bear the cost of return shipping for exchanges, unless the exchange is due to an error on our part (e.g., wrong or defective item shipped).

  • Final Sale: All items purchased during a sale or discount period are final and not eligible for exchange.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SHADES OF BEAUTY, ITS OWNERS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF OUR PLATFORM, THE DELAY OR INABILITY TO USE OUR PLATFORM, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY PRODUCTS OR SERVICES OBTAINED THROUGH OUR PLATFORM, OR OTHERWISE ARISING OUT OF THE USE OF OUR PLATFORM, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU TO US, IF ANY, FOR ACCESSING OR USING OUR PLATFORM OR PURCHASING PRODUCTS THROUGH IT.

You agree to indemnify, defend, and hold harmless Shades of Beauty, its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of our platform, your violation of these terms, or your violation of any rights of another.

12. Governing Law and Dispute Resolution

These terms and conditions are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these terms, your use of our platform, or any products or services provided by us shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India. All disputes shall be resolved in accordance with the Arbitration and Conciliation Act, 1996, as amended, with a single arbitrator mutually appointed by both parties. The arbitration proceedings shall be conducted in English and held in New Delhi, India.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
